Terms and Conditions

These Terms and Conditions apply to job postings, employer packages, subscriptions, upgrades, promotional features, and other services offered through WhoGotWork.com.

These Terms and Conditions supplement the WhoGotWork Terms of Use and Privacy Policy. If you purchase or use a paid service, you agree to these Terms and Conditions.

1. WhoGotWork Services

WhoGotWork provides an online platform where employers, businesses, contractors, organizations, property owners, and other authorized users may advertise legitimate work opportunities and connect with potential applicants.

Available services may include:

  • Individual job postings
  • Employer accounts and company profiles
  • Multiple-listing packages
  • Featured or promoted listings
  • Subscription plans
  • Sponsored placements
  • Candidate-discovery tools
  • Other employment-related services

Available features, prices, and limits may change over time.

2. Employer Eligibility

To post an opportunity or purchase an employer service, you must be legally authorized to act for the employer, business, organization, or individual offering the work.

You confirm that:

  • The information you provide is accurate and current.
  • You have authority to publish the opportunity.
  • The opportunity is legitimate and currently available.
  • The work complies with applicable laws.
  • You will honor the compensation and conditions presented to applicants.
  • You will not impersonate another person, business, or organization.

WhoGotWork may request additional information to confirm an employer’s identity, authority, or legitimacy.

3. Job-Posting Requirements

Each job posting must provide a clear and honest description of the opportunity.

Listings should include, when applicable:

  • Accurate job title
  • Employer or hiring organization
  • Job responsibilities
  • Work location
  • Employment or contract type
  • Schedule
  • Compensation or salary information
  • Required experience, licenses, or qualifications
  • Application instructions
  • Application deadline

Employers must promptly update, close, or remove listings that are filled, canceled, materially changed, or no longer accepting applications.

4. Prohibited Listings

WhoGotWork does not permit listings that are fraudulent, illegal, misleading, discriminatory, exploitative, unsafe, or unrelated to legitimate work.

Prohibited listings include:

  • Fake or nonexistent jobs
  • Opportunities that misrepresent compensation or working conditions
  • Jobs requiring applicants to send money, gift cards, cryptocurrency, or banking credentials
  • Check-cashing, reshipping, or money-mule schemes
  • Undisclosed multilevel-marketing or pyramid opportunities
  • Adult services or illegal activity
  • Positions involving unlawful discrimination
  • Opportunities that violate wage, labor, safety, licensing, or employment laws
  • Listings created primarily to collect personal information
  • Duplicate, spam, or keyword-stuffed postings
  • Opportunities copied or posted without authorization
  • Listings containing malware, deceptive links, or false contact information

WhoGotWork may reject or remove any listing that presents a potential risk to users or the platform.

5. Listing Review and Approval

Submitting or paying for a listing does not guarantee publication.

WhoGotWork may review listings before or after publication. We may edit formatting, correct obvious errors, request clarification, reject content, suspend publication, expire a listing, or remove it entirely.

A listing may be rejected or removed if it:

  • Violates these Terms
  • Contains incomplete or inconsistent information
  • Appears fraudulent or misleading
  • Creates a safety or legal concern
  • Uses an unauthorized company identity
  • Directs users to a suspicious application method
  • Has expired or is no longer accepting applications
  • Damages the integrity of the platform

Approval of a listing does not represent an endorsement, certification, or guarantee of the employer or opportunity.

6. Service Packages

Each service package may include specific features, limits, and time periods.

Package details may include:

  • Number of job postings
  • Listing duration
  • Featured-placement duration
  • Candidate-access limits
  • Company-profile features
  • Renewal terms
  • Expiration date
  • Promotional benefits

The description displayed at the time of purchase determines what is included in that package.

Unused features, listing credits, or promotional benefits may expire at the end of the stated package period unless otherwise specified.

7. Prices and Payments

Prices will be displayed before an order is submitted.

By purchasing a service, you authorize WhoGotWork and its payment processor to charge the payment method you provide for the displayed amount, including applicable taxes or fees.

You agree to provide accurate billing information and maintain a valid payment method when required.

WhoGotWork does not ordinarily receive or store complete payment-card information when payments are processed through an independent payment provider.

8. Subscriptions and Renewals

If a service automatically renews, the renewal schedule, price, and cancellation terms will be disclosed before purchase.

By selecting an automatically renewing service, you authorize recurring charges according to the disclosed billing schedule until the subscription is canceled.

You may cancel future renewals through the available account controls or by contacting WhoGotWork. Cancellation stops future renewal charges but does not automatically refund a completed billing period unless required by law or stated otherwise.

If automatic renewal is not clearly presented during checkout, the purchase will not be treated as an automatically renewing subscription.

9. Cancellations and Refunds

Because job listings, featured placements, and digital promotional services may begin shortly after purchase, payments may become nonrefundable once the service has been activated, published, or substantially delivered.

A refund may be considered when:

  • WhoGotWork is unable to provide the purchased service.
  • A duplicate charge occurred.
  • A billing error was caused by WhoGotWork.
  • Applicable law requires a refund.

Refunds generally will not be issued because:

  • A listing received fewer views or applications than expected.
  • An employer did not hire a candidate.
  • An employer changed its hiring plans after publication.
  • A user failed to use the purchased features before expiration.
  • A listing was removed for violating platform rules.
  • Incorrect information was provided by the purchaser.

Refund requests should be submitted promptly through the Contact page with the account email, purchase date, service purchased, and reason for the request.

Approved refunds will generally be returned through the original payment method.

10. No Guarantee of Results

Purchasing a listing, package, subscription, featured placement, or promotional service does not guarantee:

  • A particular number of views
  • Applications
  • Interviews
  • Qualified candidates
  • Completed hires
  • Business revenue
  • Website traffic
  • Search-engine placement
  • Social-media exposure

Results depend on factors outside WhoGotWork’s control, including the position, compensation, location, requirements, employer reputation, market conditions, and applicant interest.

11. Employer-Applicant Relationships

WhoGotWork is not a party to agreements between employers and applicants.

Employers are solely responsible for:

  • Interviewing applicants
  • Verifying qualifications
  • Checking references
  • Conducting lawful background checks
  • Making hiring decisions
  • Providing required notices and documentation
  • Correctly classifying workers
  • Paying wages or contractor compensation
  • Handling taxes, insurance, benefits, and workplace obligations
  • Maintaining lawful and safe working conditions

WhoGotWork does not supervise workers or guarantee their conduct, attendance, performance, qualifications, or suitability.

12. Applicant Information

Employers may use applicant information only for legitimate recruitment and hiring purposes connected to the opportunity for which it was provided.

Employers must not:

  • Sell applicant information
  • Use it for unrelated advertising
  • Disclose it without authorization
  • Request unnecessary sensitive information
  • Retain it longer than reasonably necessary
  • Use it for discriminatory or unlawful purposes

Employers are responsible for protecting applicant information from unauthorized access or disclosure.

13. Featured and Sponsored Placements

Featured, promoted, or sponsored services may increase the visibility or placement of a listing. They do not guarantee a specific number of impressions, clicks, applications, or hires.

Placement may vary by device, search criteria, location, category, platform activity, and other operational factors.

Sponsored content may be identified as promoted, featured, or sponsored where appropriate.

14. Service Changes and Interruptions

WhoGotWork may modify, replace, suspend, or discontinue a feature or service.

We may perform maintenance or experience technical interruptions that temporarily affect website access, listing visibility, payments, or account features.

When practical, WhoGotWork may extend a paid service or provide a reasonable alternative if a significant interruption prevents delivery. Minor interruptions do not automatically qualify for refunds.

15. Account and Listing Suspension

WhoGotWork may suspend or terminate an employer account or listing for:

  • Violating these Terms
  • Nonpayment or disputed payment
  • Posting fraudulent or prohibited content
  • Misusing applicant information
  • Impersonation
  • Repeated complaints
  • Threatening or abusive conduct
  • Creating security or legal risk
  • Attempting to bypass platform restrictions

Suspension or termination for a serious violation may result in the loss of active listings, unused credits, or paid features without refund, to the extent permitted by law.

16. Chargebacks and Payment Disputes

Before initiating a chargeback or payment dispute, users are encouraged to contact WhoGotWork so the issue can be reviewed.

Submitting a knowingly false or abusive chargeback may result in account suspension and collection of amounts legally owed.

Nothing in this section limits rights provided by applicable consumer-protection or payment laws.

17. Taxes

Users are responsible for taxes, reporting obligations, permits, licenses, payroll responsibilities, and other government requirements connected to their business, employment, contracting, purchases, or payments.

WhoGotWork may collect applicable transaction taxes when legally required.

18. Limitation of Liability

To the fullest extent permitted by law, WhoGotWork is not responsible for losses arising from:

  • An employer’s hiring decision
  • An applicant’s conduct or qualifications
  • Failure to receive applications or complete a hire
  • Inaccurate user-provided information
  • Employment or contractor disputes
  • Third-party websites or payment services
  • Temporary service interruptions
  • Unauthorized account access outside WhoGotWork’s reasonable control

Nothing in these Terms excludes liability that cannot legally be excluded.

19. Changes to These Terms

WhoGotWork may update these Terms and Conditions to reflect changes in services, prices, business practices, technology, or applicable law.

Updated terms will be posted with a revised effective date. Changes affecting an existing paid service will apply as stated in the applicable notice or as permitted by law.

20. Governing Law

These Terms and Conditions are governed by the laws of the Commonwealth of Pennsylvania and applicable federal law, without regard to conflict-of-law principles.

Any legal action not subject to another valid dispute-resolution agreement must be brought in a court with proper jurisdiction in Pennsylvania unless applicable law requires otherwise.
